These terms and conditions of sales are applicable to sales made by PMA Sales to its customers (hereinafter "Customer"). By accepting delivery, customer agrees to be bound by these terms and conditions of sale, notwithstanding Customer's terms and conditions whether or not supplied to PMA Sales at any time.
PMA Sales will acknowledge each order sent within 24 hours of receipt via E-Commerce, email or fax.
Every effort will be made to maintain the listed or quoted prices; however, prices are subject to change, without notice, due to among other things changes in cost of material and/or manufacturing services. Prices and availability information received from PMA Sales representatives or obtained through PMA Sales’ e-commerce web site are quotations and DO NOT constitute legally binding offers until Customer purchase order is accepted and acknowledged.
PMA Sales warrants its products to be free of defective materials and/or faulty workmanship for a period not to exceed 12 months from the date of sale. All warranty claims must be sent to PMA Sales for an evaluation prior to any credit being issued or replacement part being shipped. Warranty evaluations will be performed within 10 business days of the receipt of the part in question, unless testing is involved.
Test Fees
If the item being considered for warranty requires testing, a "Test Fee" will be assessed.
Other warranty considerations may be granted for large projects, programs and long term agreements. PMA Sales' liability for breach of any obligations with respect to the sale of the part is limited to refunding the invoice price of the product, or, at PMA Sales' option, replacement of the material, but not the cost of installation, removal, or collateral cost.
PMA Sales distributes several products that are shelf life limited such as elastomeric isolators, fuel system sealants and silicone RTV's. The shelf life varies by product. Cure dates are listed on each shelf life limited product we sell. Additional information is available in our product brochures or by contacting us. PMA Sales policy is to always offer these products with the greatest amount of remaining shelf life possible.
Any unused part must be received within 30 days of the sales date in order to be considered for a credit. The part must be returned undamaged in its original packaging with the original documents and is subject to our inspection and a 20% restocking fee. Within this time requirement, please contact a PMA Sales customer support representative for a Return Material Authorization (RMA) number. A Customer who does not obtain an RMA will be responsible for any excess costs incurred.
PMA Sales has no minimum sales quantities or dollar amounts, except for the following minimum PO requirement for all RTV Silicones and Fuel System & Fuselage Sealants.

Open account terms are granted pending a credit check for those customers purchasing our products on a regular basis. All open accounts must be kept in good standing at all times in order to continue penalties may apply. |

Payments from a Customer who has been given open terms should be mailed to the address shown on the invoice within thirty (30) days of receipt of the invoice or else such invoice balances will be subject to an interest charge of 1.5% per month until paid and any collection costs or fees incurred (unless special terms have been arranged). Accounts with unpaid balances over sixty (60) days will be placed on credit hold. PMA Sales reserves the right to modify or withdraw credit terms and/or credit limits at any time without notice and to require guaranteed security or payment in advance for the amount of the order.
PMA Sales maintains complete traceability on all items. All shipments are accompanied by a PMA Sales Certificate of Conformance at no additional charge. If a copy of the manufacturer's certification is required, this must be stipulated on Customer's purchase order and an additional charge may be assessed. FAA 8130-3 forms are issued with PMA Sales PMA parts.
Customer may not export or re-export any parts received under this Agreement except in full compliance with all United States laws and regulations. In particular, the Products may not be exported or re-exported to a national or resident of any country to which the United States embargoes goods, or to anyone on the U.S. Treasury Department's list of Specially Designated Nationals or the U.S. Commerce Department's Table of Denial Orders. In addition, Customer is responsible for complying with any local laws in Customer's country, which may impact Customer's right to import, export, or use the parts.
This agreement shall be deemed to have been made in the State of Arizona, U.S.A. and shall be interpreted in accordance with the law of the State of Arizona without regard to conflict of law principles. Customer consents to the exclusive jurisdiction of the state and federal courts of the state of Arizona, U.S.A., for determination of any claim or controversy between the parties and arising out of or relating to these terms and conditions of sale. In the event that PMA Sales shall engage an attorney or commence an action against Customer arising out of facts and circumstances related to these terms and conditions of sale including, but not limited to, Customer's breach of any of its obligations hereunder, PMA Sales shall be entitled to recover its reasonable attorney's fees, costs, and other disbursements incurred in connection therewith.
